Intellectual property disputes: claims, defence and resolution
An IP dispute can interrupt a launch, threaten an established business or put valuable technology at risk. I advise businesses asserting intellectual property rights and businesses responding to allegations of infringement.
My practice includes patent, trademark, copyright, industrial design, domain name and software licensing disputes, including Canadian court proceedings and negotiated resolutions.
Received a demand letter or claim?
The first step is to understand the document, the parties, the rights being asserted and any deadline. The assessment may include the available evidence, the proposed response, the commercial impact and the cost of different options.
Please identify any known deadline prominently in your inquiry. Responsibility for a deadline and the scope of representation must be confirmed through an agreed engagement.
Considering enforcement?
Before sending a demand or starting proceedings, it is important to assess the right relied on, ownership, the alleged conduct, the evidence and the remedy sought. The approach should reflect the client’s commercial objectives.
Depending on the circumstances, the appropriate route may involve correspondence, negotiation, a registry proceeding, a domain name proceeding or litigation.
Patent, trademark and copyright experience
I have experience with patent litigation involving technical subject matter, trademark and brand conflicts, copyright claims and software licensing issues. My background also includes trial and appellate advocacy.
Where a dispute concerns technical evidence, the work may involve inventors, business personnel and appropriately qualified experts. The scope of work and litigation budget should be considered as the matter develops.
A dispute plan linked to the business
The commercial questions matter alongside the legal questions: can the business continue operating, what alternatives exist, what information is needed, and what would an acceptable resolution look like?
My role is to help the client assess those choices and pursue the agreed approach.
How to make an initial inquiry
Provide your name and business, the other parties, the type of dispute, any public court or registration number, and the deadline shown on any document. Begin with a short non-confidential summary. We will confirm the appropriate arrangements before receiving detailed material.
